These Terms of Service govern your use of PixLancer. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services.

STRICT CONTENT POLICY - ADULT CONTENT PROHIBITED:

PixLancer has a ZERO TOLERANCE POLICY for pornographic, sexually explicit, or nude content. Any user found uploading, editing, or distributing such content will have their account immediately and permanently terminated without warning or refund. This includes but is not limited to: nudity, sexual acts, sexually suggestive content, and adult material of any kind.

1. Acceptance of Terms

Welcome to PixLancer ("we," "us," "our," or the "Platform"). By accessing, browsing, or using PixLancer, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy and any additional guidelines or rules applicable to specific services.

If you are using PixLancer on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

PixLancer is an online marketplace connecting individuals who need photo editing services ("Requesters") with skilled photo editors ("Editors"). Our platform facilitates:

  • Submission of photo edit requests with specific instructions
  • Assignment of requests to qualified editors
  • Review and approval of completed edits
  • Secure payment processing through integrated payment providers
  • Communication between requesters and editors
  • Quality control and dispute resolution

3. Eligibility & Account Registration

3.1 Age Requirement

You must be at least 18 years old to use PixLancer. By using our services, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain features, you must create an account by providing:

  • Valid email address
  • Secure password
  • Accurate profile information
  • Payment information (for Requesters) or payout details (for Editors)

3.3 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify us immediately of any unauthorized access to your account
  • You are liable for all activities that occur under your account
  • Sharing accounts or credentials is strictly prohibited

3.4 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

4. User Roles & Responsibilities

4.1 Requesters (Photo Submitters)

As a Requester, you agree to:

  • Submit only photos you own or have explicit permission to edit
  • Provide clear, reasonable editing instructions
  • Review submitted edits promptly and fairly
  • Pay for approved edits according to agreed pricing
  • Communicate respectfully with editors
  • Not misuse the platform to obtain free work
  • NOT upload any content containing nudity, sexual content, or adult material

4.2 Editors (Photo Editing Professionals)

As an Editor, you agree to:

  • Perform all editing work yourself (no outsourcing unless disclosed)
  • Deliver high-quality work that meets the requester's specifications
  • Meet agreed-upon deadlines
  • Not plagiarize or use unauthorized assets
  • Disclose use of AI tools when applicable
  • Maintain professional communication
  • Complete Stripe Connect onboarding to receive payments
  • Immediately report any requests involving prohibited content (nudity, sexual content, etc.)

5. Content Ownership & Licensing

5.1 Requester Content

You retain all ownership rights to photos you submit. By uploading photos to PixLancer, you grant us and assigned editors a limited, non-exclusive, royalty-free license to:

  • Display your photos within the platform
  • Allow assigned editors to download and edit them as requested
  • Store backups for service delivery and dispute resolution

This license terminates when you delete your content or close your account, except for content retained for legal or operational purposes.

5.2 Edited Content

Once you approve an edit, you receive full rights to use the edited photo as you see fit. Editors retain portfolio rights to showcase their work unless explicitly prohibited by you.

5.3 Platform Content

All content on PixLancer, including text, graphics, logos, interface design, and software, is owned by PixLancer or our licensors and protected by copyright, trademark, and other intellectual property laws.

6. Copyright & Intellectual Property

Strict Copyright Policy:

PixLancer has a zero-tolerance policy for copyright infringement. Users who violate copyright laws will have their accounts immediately suspended or terminated.

6.1 Prohibited Actions

You may NOT:

  • Upload photos you do not own or have permission to edit
  • Remove watermarks, logos, or branding from copyrighted images
  • Edit celebrity photos, stock photos, or professional photography without proper rights
  • Submit content that infringes on third-party intellectual property
  • Use platform content for unauthorized commercial purposes

6.2 DMCA Compliance

PixLancer complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, please contact us at legal@pixlancer.com with:

  • Description of the copyrighted work
  • Location of the infringing material
  • Your contact information
  • Statement of good faith belief
  • Statement of accuracy under penalty of perjury

7. Photo Submission Guidelines

When submitting photos for editing, you must ensure:

  • Legal Rights: You own the photo or have explicit permission from the copyright holder
  • File Quality: Photos meet minimum resolution requirements (as specified in our Help Center)
  • Clear Instructions: Edit requests include specific, achievable instructions
  • Appropriate Content: Photos comply with our content policy (see Section 13)
  • Reasonable Scope: Requests are feasible within standard editing capabilities
  • NO ADULT CONTENT: Photos must NOT contain nudity, sexual content, or any adult material whatsoever

8. Editor Standards & Obligations

8.1 Original Work Requirement

Editors must perform their own work. Use of pre-made templates, actions, or filters is acceptable if they result in custom work that meets the requester's specifications. However:

  • Plagiarism is prohibited: Copying another artist's work is grounds for immediate termination
  • AI Usage Disclosure: If you use AI tools (e.g., generative fill, AI upscaling), this should be disclosed when relevant
  • Stock Asset Attribution: If you incorporate stock images or textures, ensure you have proper licenses

8.2 Quality Standards

Submitted edits must:

  • Address all requirements specified in the edit request
  • Be technically sound (proper resolution, no artifacts, clean edges)
  • Match the requested style and aesthetic
  • Be delivered in the specified file format

8.3 Revisions & Communication

Editors should be responsive to revision requests and communicate professionally. Reasonable revision requests should be accommodated before final approval.

8.4 Ratings & Reviews

Editors may be publicly rated and reviewed by requesters. Your editor rating affects your visibility in the queue and eligibility for certain requests.

9. Payment Terms

9.1 Payment Processors

PixLancer uses Stripe for payment processing. All transactions are subject to Stripe's terms and conditions.

9.2 Requester Payments

  • When you approve an editor's submitted work, you will be redirected to Stripe Checkout to complete payment
  • You must add a valid payment card at checkout to purchase the approved edit
  • Once payment is successfully processed, funds are immediately transferred to the editor's Stripe Connect account
  • Payment methods accepted: Credit/debit cards, digital wallets (via Stripe)
  • All prices are displayed in USD unless otherwise specified
  • If you reject an edit, no payment is required and the request returns to the queue for another editor to claim
  • Important: By approving an edit, you commit to completing the purchase at checkout. Approval cannot be reversed once payment is processed.

9.3 Editor Payouts

  • Editors must complete Stripe Connect onboarding before they can receive payments for completed edits
  • This onboarding process verifies your identity and establishes your payout account
  • When a requester approves your edit and completes payment at checkout, funds are immediately transferred to your Stripe Connect account
  • If a requester rejects your edit, you do not receive payment and the request returns to the queue
  • Payout schedules to your bank account are determined by Stripe based on your region (typically 2-7 business days after receiving funds)
  • Minimum payout thresholds and transfer schedules vary by country and are set by Stripe
  • International editors can receive payments based on Stripe's country availability

9.4 Payment Processing Times

Once an edit is approved, payment is typically processed within 2-7 business days, depending on your bank and location.

10. Approval Process & Refund Policy

Critical Payment Policy:

Once you approve an edit, the transaction is final and non-refundable. Approval indicates that the service has been completed to your satisfaction, and payment is immediately released to the editor.

10.1 Review Period

When an editor submits their work, requesters have the opportunity to:

  • Approve: Accept the edit and release payment (final and binding)
  • Request Revisions: Provide specific feedback for improvements
  • Reject: Decline the edit if it doesn't meet requirements (editor is not paid)

10.2 No Refunds After Approval

Approval is irrevocable. Please review edits carefully before approving. We cannot issue refunds once payment has been released to the editor.

10.3 Dispute Resolution

If you believe an editor has violated our terms, failed to deliver as promised, or engaged in fraudulent behavior, contact us at support@pixlancer.com before approving the edit. Our team will investigate and mediate disputes on a case-by-case basis.

10.4 Accidental Approvals

If you accidentally approve an edit, contact us immediately. While we cannot guarantee refunds, we will review your case and work with the editor to reach a fair resolution.

11. Platform Fees & Commissions

11.1 Service Fees

PixLancer charges the following fees:

  • Platform Fee: A $0.25 USD service fee is deducted from each completed transaction
  • Payment Processing Fees: Additional fees charged by Stripe (typically 2.9% + $0.30 per transaction)

11.2 Pricing Transparency

All fees are disclosed upfront. Requesters see the total cost before payment, and editors see their net earnings after fees.

11.3 Fee Changes

We reserve the right to adjust our fee structure with 30 days' notice to users. Continued use of the platform after fee changes constitutes acceptance.

12. Quality Standards

PixLancer maintains quality through:

  • Editor Ratings: Public reviews help maintain accountability
  • Watermarked Previews: Requesters can review edits before final approval
  • Dispute Mediation: Our support team resolves conflicts fairly
  • Quality Complaints: Persistent low-quality work may result in editor account review

13. Prohibited Content & Activities

Zero Tolerance Policy:

The following content and activities are strictly prohibited and will result in immediate account termination and possible legal action.

13.1 Prohibited Content

You may NOT upload, edit, or distribute:

  • Nudity or sexual content: Any images containing exposed genitals, breasts, buttocks, or other intimate body parts
  • Sexually explicit content: Pornographic material, sexual acts, sexual situations, or sexually suggestive poses
  • Adult content: Any material of a sexual nature, including but not limited to erotica, fetish content, or sexual services
  • Sexually suggestive edits: Requests to remove clothing, add nudity, or create sexually suggestive images
  • Child sexual abuse material (CSAM) or content exploiting minors
  • Non-consensual intimate images ("revenge porn")
  • Violent, graphic, or disturbing imagery
  • Hate speech, discriminatory, or harassing content
  • Content promoting illegal activities or terrorism
  • Fraudulent documents or falsified identification
  • Deepfakes or misleading manipulated media intended to deceive
Important Clarification on Nudity:

This prohibition includes ALL forms of nudity, regardless of context. This includes but is not limited to: artistic nudes, boudoir photography, implied nudity, partial nudity, nude selfies, lingerie that reveals intimate areas, sheer clothing showing intimate body parts, or any content where nudity is the primary focus. When in doubt, do not upload. Medical, educational, or artistic intent does not exempt content from this policy.

13.2 Prohibited Activities

  • Using the platform for money laundering or fraud
  • Creating multiple accounts to manipulate ratings or circumvent bans
  • Attempting to bypass payment systems or fees
  • Scraping data or reverse-engineering the platform
  • Harassing, threatening, or doxxing other users
  • Submitting fake or spam edit requests
  • Using bots or automated tools without authorization
  • Requesting edits that would create or enhance sexual or nude content

13.3 Reporting Violations

If you encounter prohibited content or behavior, report it immediately to abuse@pixlancer.com. We review all reports promptly and take appropriate action. Editors who receive requests containing prohibited content should NOT accept the request and must report it immediately.

14. Account Termination & Suspension

14.1 Termination by User

You may close your account at any time from your Account Settings. Upon closure:

  • Your profile and public content will be removed
  • Outstanding payments will be processed
  • Some data may be retained for legal or operational purposes

14.2 Termination by PixLancer

We reserve the right to suspend or terminate your account without prior notice if:

  • You violate these Terms of Service
  • You engage in fraudulent, abusive, or illegal behavior
  • Your account is flagged for suspicious activity
  • You repeatedly receive negative reviews or quality complaints
  • We are required to do so by law
  • You upload, edit, request, or distribute any content containing nudity, sexual content, or adult material

14.3 Effect of Termination

  • Access to your account will be revoked immediately
  • Pending transactions may be reviewed or canceled
  • You forfeit any outstanding balances if termination is due to fraud or Terms violations
  • You may not create new accounts without our permission
  • Accounts terminated for adult content violations are permanently banned and cannot be reinstated

15. Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • We collect information necessary to provide our services
  • We use secure payment processors and do not store full payment details
  • We may share data with third parties as described in our Privacy Policy
  • You have rights to access, correct, or delete your personal data
  • We reserve the right to review uploaded content to enforce our content policies

16. Disclaimers & Limitation of Liability

16.1 Service "As Is"

PixLancer is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

16.2 No Guarantee of Results

While we strive to maintain high quality, we do not guarantee that:

  • Edits will always meet your expectations
  • The platform will be error-free or uninterrupted
  • All disputes will be resolved to your satisfaction
  • Editors will always deliver on time

16.3 Limitation of Liability

To the maximum extent permitted by law, PixLancer and its officers, directors, employees, and agents shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from user content or third-party actions
  • Damages exceeding the amount you paid to PixLancer in the past 12 months

16.4 Third-Party Services

We are not responsible for the actions, content, or policies of third-party services (e.g., Stripe) that you may access through our platform.

17. Indemnification

You agree to defend, indemnify, and hold harmless PixLancer, its affiliates, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you upload or submit
  • Your breach of applicable laws or regulations
  • Any prohibited content (including nudity or sexual content) you upload, edit, or distribute through the platform

18. Dispute Resolution

18.1 Informal Resolution

If you have a dispute with PixLancer, please contact us at support@pixlancer.com to attempt informal resolution before pursuing formal action.

18.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration rather than in court, except where prohibited by law. Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules.

18.3 Class Action Waiver

You agree to bring claims against PixLancer only in your individual capacity and not as part of any class or representative action.

18.4 Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

19. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes:

  • We will update the "Effective Date" at the top of this page
  • We may notify you via email or platform notification
  • Continued use of PixLancer after changes constitutes acceptance

If you do not agree to the updated Terms, you must stop using the platform and close your account.
